Job Summary

Manager position in Execution Phase Commercial Management function located in Home Office or on Project Site as appropriate.

This is a management position, responsible to internal clients in terms of all commercial aspects related to Execution Phase Commercial Management. Develop commercial strategies for claims avoidance and scope change management with support from functional management. Implements site procedures and reporting systems. Ensure project team compliance with prime contract T&C's. Ensure receipt of client authorization before start of out of scope extra work.

Management responsibility:  Key competencies typically include: knowledge of contract documentation; knowledge of contract responsibilities and construction process to support project team; ability to advise the client and project team on the project’s progress and accountability; strong leadership, strategic planning ,communication, training, analytical and mathematical skills.

Key Responsibilities

Is assigned and proactively supports projects in execution from "Day 1" to positively influence compliance with contract T&C's, claim avoidance and scope change management.

Execution Phase Commercial Management:
•Prepare and present to project team a Contract Administration Plan identifying key contractual terms such as change order processes, notice requirements, etc.
•Prepare and present to project team Commercial Awareness Training specific to prime contract.
•Management of commercial coordination and change management between prime/subcontracts/PO's/OEM's.
• Timely preparation of commercial letters, notices and other key correspondences in compliance with prime contract requirements. Ensure review and signature by PM.
• Assemble and update prime contract baseline documents for central filing (RFQ, B&V final proposal, negotiation notes and MOM's, complete/executed prime contract agreement and executed change orders and amendments.
•Support project team with identification and documentation of "scope creep"; ensure preservation of B&V's contractual entitlement to cost and schedule relief in accordance with the prescribed change order process.
•Prepare Weekly Dashboard of prime contract commercial activity (e.g. CO's in process/submitted, approved by client, notices/letters issued, weekly tasks to be achieved, main areas of concern).
 •Flag to functional management any commercial matters which may evolve into claims or disputes.
•Support project subcontract administrator and procurement manager on commercial matters.
•Point of contact of all routine prime contract/OEM questions and resulting analysis in support of the PM and project execution team.
•Identify prime contract clauses requiring flow down into purchase orders and subcontract T&Cs.
•Prepare and maintain/update the project specific Commercial Action/Responsibilities matrix.

Management Responsibilities
Supervises work of others. Responsible for hiring, discipline, and pay administration of their subordinates.
Preferred Qualifications

A Law degree will be advantageous.

  • Drafting, reviewing, negotiating and finalizing full suite of contracts related to the EPC setting including EPC (or derivative) Contracts, Coordination/ Bridging Agreements, Novation Agreements.
  • Able to lead discussions relating to assessment and application of LIFTT issues to facts to resolve project commercial issues.
  • Leadership skills to include the ability to manage, lead, guide/coach, develop, motivate, and mentor team professionals

Minimum Qualifications

Bachelor's degree in any discipline. At least seven to ten years of relevant Commercial management with Planning & Scheduling experience in Home Office or Field Office. Managed a minimum of at least three (3) commercial projects.
